1. Introduction

Welcome to SessionGuide! These Terms of Service ("Terms") govern your use of SessionGuide's website at session.guide and our services (collectively, the "Services"). SessionGuide provides a platform for photographers to share and collaborate on photoshoot locations.

By using our Services, you agree to these Terms. If you're using SessionGuide on behalf of an organization, you're agreeing to these Terms for that organization and confirming you have authority to bind them to these Terms. In that case, "you" refers to that organization.

Important: Our Services are only available to users in the United States. We use Cloudflare geo-blocking to restrict access to US users only. By using our Services, you confirm that you are located in the United States.

Note: SessionGuide is an early-stage platform in active development. Features may change as we grow and improve the platform. We appreciate your patience and feedback as we build the best possible service for photographers.

2. Account Registration

2.1 Creating an Account

SessionGuide offers two types of accounts:

Photographer Accounts (Full Platform Access):

Designed for professional photographers and content creators
Full platform functionality including creating and sharing locations
Ability to create guides and collaborate with clients
30-day free trial (no credit card required)
Subscription-based pricing tiers after trial
Password-based authentication

Client Accounts (Limited Access):

Designed for clients exploring photographer locations
View photographer guides and locations
Save favorite locations for easy reference
Authentication via magic link (passwordless email authentication)
No subscription required
Required information: email address, first name, and last name
Optional: profile picture

Requirements for All Accounts:

Be at least 13 years old (see Section 3 for details)
Provide accurate and complete information
Maintain the security of your account credentials
Promptly update your information if it changes
Be responsible for all activity under your account

2.2 Account Security

For Photographer Accounts:

Keep your password confidential
Use a strong, unique password for your SessionGuide account
Not share your account with others
Enable two-factor authentication when available
Immediately notify us of any unauthorized use

For Client Accounts:

Maintain control of your email account used for authentication
Do not share magic link authentication emails with others
Magic links expire after 15 minutes for security
Each magic link can only be used once
Immediately notify us if you suspect unauthorized access to your email

For All Accounts:

We may suspend accounts that appear to be compromised
You are responsible for all activity under your account
Report security concerns to [email protected]

2.3 Business Accounts

For business or team accounts:

The organization owns all content and data in the account
Authorized administrators can manage user access
When employees leave, the organization retains access to content
Organizations are responsible for their users' compliance with these Terms

3. Age Requirements and Children's Privacy

You must be at least 13 years old to use SessionGuide. We do not knowingly collect personal information from children under 13. If we learn that we've collected information from a child under 13:

We will delete the account and information promptly
We may attempt to notify the parent or guardian
The parent or guardian can contact us at [email protected]

If you believe a user is under 13, please report it to us immediately.

4. Acceptable Use

4.1 You May:

Photographer Accounts:

Use SessionGuide for lawful business and personal photography purposes
Share location information and photos you have rights to share
Create and manage guides for clients
Collaborate with other photographers and clients
Access the Services from multiple devices
Monetize your content through the platform (subject to subscription tier)

Client Accounts:

Browse and view photographer guides and locations
Save favorite locations to your personal list
Access saved favorites from multiple devices
Share guide links with others
Contact photographers through the platform

4.2 You May Not:

Violate any laws or regulations
Infringe on others' intellectual property rights
Upload malicious code or interfere with the Services
Attempt to gain unauthorized access to any part of the Services
Harass, abuse, or harm other users
Create multiple accounts to evade restrictions
Use automated means to access the Services without permission
Resell or redistribute the Services without authorization
Share locations that are dangerous, illegal to access, or on private property without permission
Use the Services for any illegal or harmful purposes

5. Usernames and URLs

5.1 Username Selection

When you create an account, you'll select a username that becomes part of your SessionGuide URL (e.g., session.guide/@your-username). Your username must:

Accurately represent you or your business
Not impersonate others or mislead users
Not include offensive, inappropriate, or harmful language
Not infringe on trademarks or intellectual property rights
Be appropriate for a professional photography platform

5.2 Our Rights

We reserve the right to:

Refuse, change, or reclaim any username for any reason
Remove usernames that violate these Terms
Reclaim inactive usernames after 12 months of inactivity
Take action against usernames that could harm SessionGuide's reputation

5.3 Changes

If we require you to change your username:

We'll notify you via email with the reason
You'll have 14 days to select a new username
If you don't select a new username, we may assign one or suspend your account
We'll implement redirects when reasonably possible

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of content you upload ("Your Content"). By uploading content, you grant SessionGuide a worldwide, non-exclusive license to use, store, display, and distribute Your Content solely as necessary to provide the Services.

You represent and warrant that:

You own or have rights to use all Your Content
Your Content doesn't violate these Terms or any laws
Your Content doesn't infringe on anyone's rights

6.2 Photo Rights and Model Releases

You are solely responsible for:

Obtaining all necessary model releases for people in your photos
Securing property releases where required
Respecting privacy rights of individuals
Ensuring you have rights to photograph and share all locations

SessionGuide is not responsible for verifying rights or releases. Any legal issues arising from your photos are your sole responsibility.

6.3 Location Information

When sharing location information:

You can choose to share exact or approximate locations
Consider safety and privacy before sharing sensitive locations
Don't share locations that require illegal trespassing
Respect private property rights
Include relevant warnings about safety or access restrictions

Location data you share may be visible to other users based on your privacy settings.

6.4 SessionGuide's Property

The Services, including all software, design, text, images, and logos, are owned by SessionGuide or our licensors. You may not:

Copy, modify, or create derivative works
Reverse engineer or attempt to extract source code
Remove or alter any proprietary notices

6.5 Feedback

If you provide suggestions or feedback about our Services, we may use it without obligation to you.

6.6 Client-Generated Content

For Client accounts:

Your favorites lists and saved locations are your personal data
You can add, remove, and organize favorites at any time
We may use anonymized, aggregated data about popular locations to improve our Services
Your favorites are private unless you choose to share them
You retain control over your favorites data and can delete it at any time

7. Content Moderation and Community Guidelines

7.1 Community Standards

SessionGuide is a professional photography platform. Content must be:

Relevant to photography and location scouting
Respectful and professional
Appropriate for all audiences
Truthful and not misleading

Content must NOT include:

Nudity or sexually explicit material
Hate speech or discrimination
Violence or graphic content
Spam or repetitive content
False or misleading information about locations

7.2 Reporting Content

To report violations:

We'll review reports within 48 hours
We may contact you for additional information

7.3 Our Rights

We may, without notice:

Remove content that violates these Terms
Suspend or terminate accounts for violations
Report illegal content to law enforcement
Take any action we deem necessary to protect our users and Services

8. Copyright Policy and DMCA

8.1 Copyright Infringement Claims

8.2 Counter-Notice

If your content was removed in error, you may send a counter-notice including:

Statement under penalty of perjury that removal was in error

Your physical or electronic signature

8.3 Repeat Infringers

We will terminate accounts of users who repeatedly infringe copyrights.

9. Privacy and Data

9.1 Data Collection

Your use of our Services is subject to our Privacy Policy. Key points:

We collect only necessary information to provide Services
We don't sell your personal information
We use industry-standard security measures
You can request deletion of your account and data

9.2 Data Export

You can export your data at any time:

Available in text format
Includes your profile, photos, and location data
Does not include other users' private information
Requested via email to [email protected]
Delivered within 7 days

9.3 Data Security

We implement security measures including:

Encryption in transit and at rest
Regular security audits
Access controls and monitoring
Incident response procedures

In case of a data breach affecting your information, we'll notify you as required by applicable law.

10. Payment Terms

10.1 Subscriptions

30-day free trial for all new photographer accounts (no credit card required)
After trial, subscriptions are billed monthly or annually in advance
Prices are in US dollars and exclude taxes unless stated
You're responsible for all applicable taxes
We use Stripe for secure payment processing
Credit card only required when you choose a paid plan

10.2 Free Trials

All new photographer accounts receive a 30-day free trial
No credit card required to start your trial
Full access to features in the highest offered tier during trial
Choose a paid plan anytime during or after your trial
If no plan is selected after 30 days, account stays active but loses access to all features
No automatic charges - you must actively choose to subscribe

10.3 Renewals and Cancellations

Paid subscriptions auto-renew unless cancelled
You can cancel anytime from your account settings
Cancellations take effect at the end of the current billing period
No refunds on paid subscriptions - please use the 30-day free trial to ensure SessionGuide meets your needs
Access continues until the end of your paid period after cancellation

10.4 Changes to Pricing

We may change prices with 30 days' notice
You can accept new prices or cancel your subscription
Continued use after price changes indicates acceptance

10.5 Failed Payments

If payment fails:

We'll attempt to collect payment again
We may suspend access until payment succeeds
Accounts over 90 days past due may be terminated

11. Service Availability and Changes

11.1 Service Availability

We strive for 99.9% uptime but don't guarantee it
Services may be unavailable for maintenance or other reasons
We're not liable for any unavailability or service issues

11.2 Service Changes

We may:

Add, modify, or remove features
Change or discontinue Services with reasonable notice
Update these Terms with notice to you

11.3 Accessibility

We're committed to making SessionGuide accessible:

We follow WCAG 2.1 AA guidelines where possible
Report accessibility issues to [email protected]
We continuously work to improve accessibility

12. Termination

12.1 By You

You may:

Cancel your subscription anytime (access continues until end of billing period)
Delete your account instantly through your profile settings
Account deletion is completely self-service - no need to contact support
Deletion is immediate and irreversible

12.2 By SessionGuide

We may suspend or terminate your account if you:

Violate these Terms
Engage in fraudulent activity
Haven't logged in for 12 months (with 30 days' notice)

12.3 Effect of Termination

Upon termination:

Your right to use Services ends immediately
We may delete Your Content after 30 days
Payment obligations for prior use survive
You can request data export before deleting your account (self-service deletion available anytime)

13. Disclaimers and Limitations

13.1 Disclaimers

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Location Disclaimer: We don't verify the accuracy, safety, or legality of accessing locations shared on SessionGuide. Users access locations at their own risk.

Map Data Disclaimer: Location data and maps are provided by Google Maps. We don't guarantee the accuracy of map data, directions, or location information. Always verify location accessibility and safety independently.

13.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

SessionGuide won't be liable for indirect, consequential, or punitive damages
Our total liability won't exceed the amount you paid us in the past 12 months
These limitations apply regardless of legal theory

13.3 Indemnification

You'll defend and indemnify SessionGuide from claims arising from:

Your violation of these Terms
Your Content
Your use of the Services
Any photography activities based on our Services

Disputes will be resolved through binding arbitration
Arbitration will be conducted by JAMS under its rules
Arbitration will occur in Columbus, Ohio
Each party bears its own costs
Class actions and class arbitrations are not permitted

14.3 Exceptions

You or we may bring suit in court for:

Intellectual property disputes
Seeking injunctive relief

16. Additional Terms for Specific Features

16.1 API Access (if applicable)

Additional terms apply if you access our API:

Comply with rate limits and documentation
Don't use the API to compete with SessionGuide

Your use of third-party services is governed by their terms
We're not responsible for third-party services

16.3 Google Maps

Our Services incorporate Google Maps features and content. Your use of Google Maps is subject to:
